Gonçalo Almeida, a sports law expert, spoke exclusively with Bola na Rede about the cases «Mourinho» and «Luís Suárez». He believes that modern football has evolved into a model where agreements are made first at a political or personal level and only then formalized legally. Almeida asserts that formalization always occurs after negotiations, and negotiations always occur, or he would say almost always, between the main interested parties. In this case, it would be Real Madrid and José Mourinho. And then, between these parties, there is a third party, very important in the business, that is contacted, which is Benfica. It makes no sense for José Mourinho to contact Benfica without knowing if Real Madrid would want to hire him. Therefore, I think in this case, normality prevailed. Almeida also asserts that an agreement for a coach to assume functions conditional on the outcome of internal elections of a club has a legally binding nature in sports law. He believes that there will be an agreement between Sport Lisboa and Benfica and Marco Siva, making faith in what the media disclose that Marco Siva will be the elected coach. And in that agreement, there will be a safeguard. That agreement will be valid, provided that, effectively, José Mourinho signs for Real Madrid. And that type of contractual clauses are perfectly valid at the universal level and recognized by FIFA.
